Terms of Service
The short version
- You own what you write and what the model writes for you, and you're responsible for how you use it. We're not liable for what happens when you do.
- The model can make mistakes. Check the output before you use it, especially numbers, names and facts.
- One free account per person. Don't try to get around the limits.
- All payments are final. We don't give refunds, except where the law requires it.
- Delete your account and your data is deleted with it.
1. Introduction and acceptance
These Terms of Service (“Terms”) are an agreement between you and Gabriel Torres (“Grainwrite”, “we”, “us”, “our”) and cover your use of grainwrite.com and everything on it.
You accept these Terms by ticking the box when you create an account, or by using Grainwrite. If you don't agree, don't use the service.
Changes. We may update these Terms as the service, our data practices or the law change. For significant changes, we'll email you or show a notice on the site at least 14 days before they take effect. Continuing to use Grainwrite after that means you accept the new Terms. If you don't, you can delete your account before they apply.
2. Definitions
| Service | The Grainwrite website, the rewriter, and everything we provide through them. |
| Account | Your registered profile, identified by your email address. |
| Input | Text you submit to be rewritten. |
| Output | The rewritten text the model returns to you. |
| Credits | The unit we charge usage in. A request costs one credit for each word of Input (not Output), plus any per-request fee shown on the Plans page. |
| Free allowance | The credits the Free plan includes each calendar month. |
| Bought credits | Credits you pay for. They don't expire while your Account exists. |
| Subscription | A paid plan, such as Pro, that renews automatically each month. |
| Promo code | A code we issue that gives credits, plan time or a discount. |
| Model | The AI language model that produces the Output. |
3. Description of the Service
Grainwrite rewrites Input using an AI Model, so that it reads more naturally while keeping its meaning. It runs in a modern web browser with JavaScript enabled and an internet connection.
3.1 AI output
Output can be wrong. The Model may change a fact, drop or alter a number, misread your meaning, or produce awkward text. It is random, so the same Input gives different Output each time. Review Output before relying on it. We don't guarantee any particular result, including how Output is judged by people or by third-party tools. What you do with Output is your responsibility (section 7.2).
3.2 Availability
We aim to keep Grainwrite running, but we don't promise uninterrupted service or any specific uptime. In particular:
- When the Model hasn't been used for a while, its GPU switches off, and the next request waits while it starts up.
- Free plan requests share limited capacity and may wait in line, or fail with a request to try again, when it's busy.
- Our providers can run short of GPU capacity, which may delay any plan.
- We may pause the Service for maintenance or updates, and will try to keep that brief.
We may change, add or remove features. If we shut the Service down entirely, we'll give at least 30 days' notice.
3.3 Third parties
Grainwrite relies on third-party providers for hosting, databases, GPUs, email, sign-in and payments; they're listed in our Privacy Policy. The Model is built on open-source AI technology and trained further by us. If you sign in with Google, Google's own terms also apply to that sign-in.
4. Eligibility and your responsibilities
4.1 Who can use Grainwrite
- You must be at least 13, or at least 16 in the European Economic Area and the United Kingdom. If you're under the age of majority where you live, you need a parent's or guardian's permission.
- You must be able to form a binding agreement, and not be barred from using the Service under the laws that apply to you.
4.2 Your Account
- Give accurate information and keep it up to date.
- Keep your sign-in details secure. You're responsible for activity under your Account. Tell us promptly if you think someone else has accessed it.
- One free Account per person. We use automated checks to detect linked Accounts, and an Account that appears linked to another may lose its free allowance. It can still use Credits and Subscriptions.
4.3 Acceptable use
You agree not to:
- use the Service for anything illegal, or to create content that harasses, threatens, defames or impersonates someone;
- produce spam, phishing, malware, or deceptive content meant to defraud people;
- submit Input you don't have the right to use, or that infringes someone else's rights;
- get around usage limits, for example by creating multiple free Accounts, automating sign-ups, or bypassing bot checks;
- scrape the Service, resell access to it, or build a competing service on top of it;
- probe, attack or overload our systems, or try to reach parts of the Service you're not meant to.
Many schools, employers and publishers have rules about AI-assisted writing. Following the rules that apply to you is your responsibility.
4.4 Your content and our intellectual property
You keep all rights to your Input and Output. You give us only the limited, temporary permission needed to process your Input to provide the Service. We don't store your Input or Output, or use them for training. The Grainwrite name, logo, website and software belong to us. These Terms don't give you any rights to them beyond using the Service.
5. Pricing, payment and termination
5.1 Plans
- Free: a monthly credit allowance that resets on the 1st of each month, UTC. Unused free credits don't carry over.
- Bought credits: credits you buy. They don't expire while your Account exists, can't be transferred, and have no cash value. Your monthly allowance is used first, then bought credits.
- Pro: a Subscription with a larger monthly allowance, billed monthly from the day you subscribe.
Current prices and allowances are shown on the Plans page.
5.2 How credits are charged
Credits are charged when you start a request: one for each word of Input, plus the per-request fee for your plan shown on the Plans page. Different features can cost different amounts, and the current costs are always shown on the Plans page and before you run a request. Re-rolling or rewriting a selection is a new request and is charged again. If a request fails before the Model finishes, its credits are returned to you.
5.3 Payment
- Payments are processed by Stripe, using the methods offered at checkout. We don't see or store your full card details.
- Prices are in US dollars (USD). Applicable taxes are added at checkout where required.
- Subscriptions renew automatically each month and are charged to your payment method until you cancel.
- If a payment fails, we may pause paid features until it's resolved.
- If we change a Subscription's price, we'll tell you at least 30 days before it applies, and you can cancel before then.
5.4 No refunds
All payments are final and non-refundable. This includes bought credits, whether used or unused, and Subscription periods, including partly used months. When you cancel a Subscription, it ends immediately and you lose access to Pro straight away. The rest of that billing period isn't refunded, so you may prefer to cancel close to your renewal date. Credits returned for failed requests (section 5.2) are returned as credits, not money.
This doesn't affect any refund or cancellation rights you have under consumer protection law that can't be waived. Where such a law applies to you, it takes priority over this section.
5.5 Promo codes
Promo codes have no cash value, can be used once per person, may expire or be withdrawn at any time, and can't be combined unless we say so. We may reverse benefits obtained by abusing codes, for example by redeeming one code across several Accounts.
5.6 Ending your Account
- You can delete your Account at any time in Settings. Deletion is immediate and permanent. Any remaining Credits and Subscription time are lost and aren't refunded. Deleting your Account also cancels any active Subscription immediately, so you won't be billed again.
- We may limit, suspend or close an Account that breaks these Terms, including Accounts used to get around free limits. Where reasonable, we'll explain why and give you a chance to respond. Payments aren't refunded when an Account is closed for breaking these Terms.
5.7 Your data after termination
We keep your data only while your Account exists. When your Account is deleted, by you or by us, your personal data is deleted with it: your login, profile, usage history, Credits and promo code redemptions. Your Input and Output are never stored in the first place.
There are two narrow exceptions. First, if you used credits in the month you delete your Account, we keep a one-way hash of your email address and that month's credit count until the end of the month, so that deleting and re-creating an Account can't reset the free allowance. It's deleted automatically at the start of the next month; see the Privacy Policy. Second, our payment provider keeps records it must by law, such as invoices for tax purposes.
6. Data protection and privacy
Our Privacy Policy explains what we collect and why, who processes it, how long we keep it, how we protect it, and your rights, including access, correction and deletion. It forms part of these Terms. In short: your text isn't stored, we keep only what's needed to run your Account, and abuse-prevention signals such as IP addresses are stored only as one-way hashes.
7. Disclaimers and limitation of liability
7.1 Disclaimer
To the extent the law allows, the Service and all Output are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
7.2 Your use of Output
How you use Output is your decision and your responsibility. Grainwrite produces text. It doesn't decide where that text goes, and we have no control over what you do with it.
To the extent the law allows, we aren't liable for any consequence of using Output, or of relying on it, including:
- Academic and professional consequences, such as a grade, a finding of academic misconduct, discipline at work, or the loss of a job, contract or client.
- Findings by third-party tools or reviewers, including plagiarism checkers and AI-detection tools, whatever result they give.
- Intellectual property claims. We don't promise that Output is original or free of other people's rights, and Output may resemble existing text.
- Errors in Output, such as a changed number, name, date, quotation or fact, and any decision made because of one.
- Publishing or submitting Output anywhere, including to a school, employer, publisher, client, court or government body.
- Breaking a rule of a school, employer, publisher or platform about AI-assisted writing.
Before you use Output for anything that matters, check it yourself, and make sure using it is allowed where you plan to use it.
7.3 Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or opportunities, arising from your use of, or inability to use, the Service or any Output, including the matters listed in section 7.2. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$20. Nothing in these Terms limits liability that the law doesn't allow to be limited.
7.4 Things outside our control
We aren't responsible for delays or failures caused by events beyond our reasonable control, including outages at our hosting, GPU or payment providers, internet failures, natural disasters, and actions by governments.
7.5 Indemnity
To the extent the law allows, you agree to cover our reasonable losses and costs if a third party makes a claim against us because of your Input, the way you used Output, or your breach of these Terms.
7.6 Disputes
If you have a problem, email support@grainwrite.com first. Most issues can be sorted out quickly, and we'll try to resolve it informally within 30 days before either of us takes it further.
7.7 Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and disputes go to the courts of Ontario. If you're a consumer, you also keep the protection of the mandatory laws of the place you live, and you may bring a claim there.
7.8 General
If any part of these Terms is found unenforceable, the rest still applies. If we don't enforce a right right away, we haven't given it up. These Terms and the Privacy Policy are the whole agreement between us about the Service.
